Terms and Conditions

  1. These terms and conditions apply to this competition (the “Rules”). By submitting an Entry, entrants agree to be bound by these Rules.
  2. This competition is hosted by Saatchi Online (“Saatchi”) and the prize is provided by Channel Four Television Corporation of 124 Horseferry Road, London SW1P 2TX (“Channel 4”).
  3. The competition runs from 10am 19 March 2008 until 6pm on 13 April 2008 and a winner will be announced before the end of April.
  4. Saatchi and Channel 4 reserve the right to cancel or amend the competition or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Saatchi or Channel 4's reasonable control. Any changes will be posted within these terms and conditions.
  5. In the event of any dispute regarding the Rules, conduct, selection process and all other matters relating to a competition, the decision of Saatchi and Channel 4 shall be final and no correspondence or discussion shall be entered into.
  6. Qualifying Entrants
  7. The competition is only open to artists registered on Saatchi Online or STUART who graduated from a BA or MA fine art course at a UK art school, college or university in 2006 or 2007. You do not have to hold a British passport to enter the competition. By entering the competition, you hereby warrant that all information submitted by you is true, current and complete. Saatchi and Channel 4 reserve the right to verify the eligibility of all entrants.
  8. All applications to the competition should be made on Saatchi Online (www.saatchigallery.com) and Saatchi’s website terms and conditions shall also apply (http://www.saatchi-gallery.co.uk/TsandCs.htm). The address/email address and telephone number you provide with your competition entry (“Entry”) will be used to contact you so please make sure this is correct.
  9. Competition entries must be made in the manner and by the closing date set out below. Failure to do so will disqualify the Entry.
  10. Saatchi and Channel 4 reserve the right to disqualify any entrant if they have reasonable grounds to believe the entrant has breached any of the Rules.
  11. In the event that any entrant is disqualified from the competition, Saatchi and Channel 4 reserve the right to select a replacement. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
  12. Proof of emailing cannot be accepted as proof of delivery. Saatchi and Channel 4 cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside Saatchi or Channel 4’s control.
  13. Entrants should note that Saatchi and Channel 4 do not accept responsibility for the return of any Entries.
  14. YOUR ENTRY
  15. Each eligible Saatchi Online or STUART graduate (see section 5) will be able to submit one Entry only. The Entry should take into consideration the 50-foot-high metal '4' (the “Big 4”) which has been constructed on the steps of Channel 4's headquarters in Horseferry Road, London SW1. Your Entry will need to work with this pre-existing structure and you may wish to visit the site before uploading your Entry.
  16. Your application must include the following:
    1. no more than 300 words about the work of art you would like to make to go outside Channel 4's headquarters - bearing in mind that your work must incorporate the Big 4;
    2. no more than 4 images relating to your Entry. These can be drawings, photographs of models/maquettes of your work or any other images you feel are relevant to convey the work you’d like to make;
    3. no more than 6 images of work you have made since graduating in 2006 or 2007;
    4. information about the UK college, art school or university you attended, and the degree that you took (BA, MA or another post-graduate course);
    5. information about where you where born, your contact details and your age; and
    6. a photo of yourself.
  17. Prizes
  18. The competition will be judged by Saatchi and Channel 4 who will be looking for an entry which they believe will take the Big 4 in a dramatically new direction, work in an ambitious and original way with the existing structure, is suitable and is fully feasible within the timeframe given for this competition. Please contact us if you wish to request a list of the judges. In all matters, the decision of the judges will be final and no correspondence or discussions shall be entered into.
  19. The competition will close at 6pm on 13 April 2008 and the winner will be notified by email before the end of April. Return of any prize notification as undeliverable or failure to reply in accordance with the notification (and within the time stated) may result in disqualification and selection of an alternate winner.
  20. Once a winning entry has been selected and the winner has been notified, Channel 4 will (at its sole discretion) engage a third party supplier to reproduce the winning entry on the Big 4 (the “Commission”). The launch date for the Commission is intended to take place around April 2008 but an exact date for launch will be confirmed by Channel 4 nearer the time.
  21. Intellectual Property Rights and Use of Entries
  22. In consideration of Saatchi and Channel 4 agreeing to consider entrants to the competition, each entrant hereby grants to Saatchi and Channel 4 an irrevocable, royalty free, non-exclusive licence to reproduce the entry in any material form, to copy, issue copies, perform, construct, broadcast, record, make available, adapt, edit, add to and otherwise use the material submitted by you as part of your Entry throughout the world on all media, whether now known or in future invented, in perpetuity without being subject to further conditions or payments. You hereby waive any moral rights in your material and grant all necessary consents for Channel 4 and Saatchi to use your material. If you win, you may be required to sign a release form in connection with the use of the winning entry.
  23. Furthermore, any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Channel 4 and Saatchi reserve the right, but not the obligation, to screen, filter and/or monitor any Entry or information provided by you to edit, refuse to distribute or remove the same.
  24. Liability
  25. Saatchi and Channel 4 cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or arising from the Commission. Saatchi and Channel 4 are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Saatchi and Channel 4’s liability for death or personal injury arising from negligence.
  26. Data Protection and Publicity
  27. The winner may be requested to take part in promotional activity and Saatchi and Channel 4 reserve the right to use the names and addresses of the winner, their photographs, images, drawings, models/maquettes and any audio and/or visual recordings of them or their entry in any publicity.
  28. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and by entering the competition you agree to Saatchi sharing your personal information with Channel 4 and the judges. Saatchi, Channel 4 and the judges will not disclose personal data to a third party without the individual’s prior consent. Please see Saatchi’s and Channel 4’s privacy policy for further details. Data relating to entrants will be retained by both Saatchi and Channel 4 for a reasonable period after the competition closes to assist Saatchi and Channel 4 in running the competition in a consistent manner and to deal with any queries arising from the competition.
  29. Jurisdiction
  30. The competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
